War service: Egypt, Gallipoli Tried by Field General Court Martial, 10, 11, 12 January 1916. Charge 1: Using threatening language to his superior officer, in that he at Abbassia on 23/12/15 after being checked by Segt. E.H. Maxwell of 10/11th Battalion A.I.F., said to him "Don't forget we come from the same time you fucker and when we get back to Australia I will settle with you" or words to that effect. Charge 2: An act to the prejudice of good order and military discipline, in that he at Abbassia on 23/12/15 when ordered to report to his Company Commander by Sergt. E.H. Maxwell, 10/11th Battalion A.I.F. deliberately spat in the face of the said Sergt. E.H. Maxwell. Charge 3: Striking his superior officer being in the execution of his office, in that he at Abbassia on 23/12/1915 struck with his fist in the face Sergt. E.H. Maxwell, 10/11th Battalion A.I.F. Found Guilty on all charges. Sentenced to imprisonment with hard labour for 2 years. Commenced return to Australia on board HT 'Itonus', 10 June 1916; taken into custody, Perth, awaiting receipt of an authorising warrant; held for 4 months without the necessary authority; Adjutant General ordered his release and discharge, with all pay to be forfeited.
